Overview Of Online Gambling Laws and Jurisdiction

Overview Of Online Gambling Laws and Jurisdiction

Have you ever thought about whether or not gambling online is legal in your country of residence? Or have you ever thought about a situation where you can register and play in one online casino but are prohibited from doing so at another?

Although the Internet’s reach is now worldwide, there is no particular legislation that covers the legality of online gambling for the entire world. Most countries have their online gambling laws and regulations. This leads to complications as rules and regulations can vary extremely from one region to another. Therefore, this is where Online Gambling Jurisdiction comes in the picture.

Within these jurisdictions, there are official licensing authorities that are responsible not only for issuing licenses but also for regulating the licensees.

Licensees are obliged to deploy a regular percentage of their workforce and operations in the territory of the jurisdiction where they obtained their licenses from. Only then they can offer services to customers legislatively.

Online Gambling Laws Around the World

United States

When the United States passed the Unlawful Internet Gambling Enforcement Act (UIGEA), it changed gambling restrictions to some extent. It became illegal for some financial businesses to process transactions between US residents and gambling sites. A lot of online casinos took this as a clear implication that the US government considered online gambling illegal and stop accepting bettors from the US.

Today the legal aspect is changing again. Several states have introduced legislation that openly makes online gambling legal, and some states even issued gaming and betting licenses to operators wishing to provide their services within the states. Other states have stated plans to do the same, while others are continuing to discuss the issue.

Canada

The laws linking to online gambling in Canada aren’t clear. There is legislation in the country which makes it illegal for any online casinos to provide gaming services to Canadian Citizens without license from the government.

However, there is no law that makes it illegal for Canadians to gamble online that are located overseas. The individual areas within Canada can regulate gambling in their regions. Some local governments operate their online gaming outlets.

United Kingdom

Online gambling is completely legal in this country and it is pretty well regulated. Sites operating in and outside the country can offer their services to UK residents. The clear legislation and strong ordinance in the UK make this country an attractive market for operators. The only problem is that they have a bigger tax rate.

Europe

Europe is made up of many countries, and certain countries are individually responsible for their legislation. Online gambling laws in Europe differ from each country, European Union members are ruled by the European Commission, which made an impact on what they can and can’t do.

The industry is properly regulated in some countries and less in others. However, they can generally free to pass their laws if they wish.

Australia and New Zealand

The online gambling legislation in Australia is covered primarily by the Interactive Gambling Act of 2001 (IGA). This law makes it illegal for Australian businesses to offer some gambling services to Australian nationals. Momentarily they are only allowing sports betting and lottery games.

However, there is no law specifically prevents Australians from using outside the country gambling sites. Regulation is carried out by both central authority and local governments.

Laws concerning online gambling in New Zealand are quite straightforward. All kinds of online betting and gaming are prohibited, but this only applies to businesses based in the country. The 2003 Gambling Act simply sets exactly what is and is not legal.

Asia

Similar to Europe, the countries in Asia are individually responsible for legislating their gambling act. The laws can be different from each country, all forms of land-based gambling are legal in some region, but illegal in others. So, there’s just as much difference in terms of the online gambling laws also.

Online Gambling Jurisdiction and Licensing Authorities

Curacao

They began licensing companies for betting and gaming back in 1996, when Curacao’s e-Gaming Licensing Authority was established. The government issues a single master license to qualified operators, including all forms of gambling.

Costa Rica

It is a home of many companies in the online gambling industry. Companies do have to be licensed to operate legally within the country, but particular betting and gaming licenses are not required

Malta

It is one of the largest online gambling jurisdictions within the European Union. The Lotteries & Gaming Authority (LGA) is liable for all law and licensing in the area, and it investigates all prospective licenses before approval.

Isle of Man

The licenses are issued by the Gambling Supervision Commission and the requirements for a business to be licensed are very strict.

Alderney

The Alderney Gaming Control Commission (AGCC) has very strict rules and regulations for their licensees. Some of the best gambling sites are licensed by the AGCG, which usually ensures that they are a reliable operation.

We suggest that you learn about the regulation within different jurisdictions. Some authorities are very strict, while others are eased.

This means that not all operators are controlled to the equal standard of regulation, which is something you might want to be aware of. There can be an edge using sites that licensed in the stricter jurisdiction. So choose wisely!
